Wills, Probate, Trusts & Elderly Client

We can assist with a variety of matters including, but not limited to:

Wills: The results of not making a Will can have unpleasant ramifications and be very stressful for your dependants and especially unmarried partners. Drafting a Will is not very expensive when compared with the advantages that can be gained, for example appointing guardians for your children and Inheritance Tax mitigation for your estate. A home made Will or one drafted by an unqualified, unregulated Will maker, may be more dangerous than having no Will at all!

Tax and Estate planning: More and more estates are being hit by Death Duty (Inheritance Tax). Make an appointment to discuss what you can do to mitigate or avoid this unfair Tax. For example, by using Tax Efficient Wills you could save your dependants over £100,000 in Inheritance Tax.

You have been taxed throughout your lifetime on a number of occasions, why should your estate pay any extra Tax when you die?

Trusts: Being a trustee is a complex and dangerous business and trustees can be personally liable for mistakes made! Trusts are, by nature, complicated and we deal with the administration of many Trusts and can assist you with the day to day Trust management, or implementation and drafting of a Trust from initial instructions. Trusts are also a useful vehicle to mitigate Inheritance Tax and can be used to protect assets for the young or those unable to look after themselves.

Enduring Power of Attorney (EPA): Have you ever considered who would look after you if injury or illness rendered you incapable of managing your financial affairs? Making an EPA can give you the peace of mind that there will be someone to look after you.

Receivership & The Court of Protection: If you were to lose your mental capacity to deal with your financial affairs, and have not made an EPA, an application for a Receivership order with the Court of Protection could potentially be the only answer to the problem. This can be a difficult and lengthy procedure. We can help you with the entire application process. Morrison & Masters also have experience as Professional Receivers and dealing with Statutory Will applications.

Elderly Client: With an ageing population the need to be prepared for old age has never been greater. We can advise you regarding issues including care home funding, the protection of assets and challenging assessments denying NHS continuing care. We can also advise you on Living Wills so that your wishes, could be conveyed to your friends, family and your medical staff as regards what medical treatment you would like to receive if you became incapable of conveying your thoughts

Probate: It is always sad when someone you are close to dies and at this difficult time dealing with their estate may be the last thing that you want to do. Administering an estate is a complicated procedure and we can deal with everything to avoid the complications, distress and potential pit-falls. We can also advise you regarding Deeds of Variation for Deceased’s estates to save Inheritance Tax.

We can also advise and act on making and defending claims brought about as a result of a contested Will or Estate.
